Decision delayed on fate of man who allegedly raped infirmary resident

justice

The man accused of raping a 69-year-old resident of the St Mary Infirmary will have to wait until Tuesday, April 4 for the decision that will be made in his case.

The decision was deferred when the matter was called up in the St Mary Circuit Court on Thursday, March 30.

Asha Lowe of Tryall in the parish is the man charged with rape and indecent assault.

In Lowe’s previous court appearance on March 16, a fitness to plea hearing was held in the case. Several members of a jury had determined that he is not fit to be pleaded.

Several psychiatric evaluations, which have been ordered by the court over a number of circuit sittings, have revealed that the accused man was not fit to plea to the charges.

However, high court judge Justice Sarah Thompson-James was to make a decision in the case last Thursday.

The decision will be made Tuesday at an extended sitting of the circuit court.

Lowe’s bail was extended until that time.

He was arrested and charged with rape and indecent assault in March of 2014 after he was pointed out in an identification parade, following the alleged incident on February 9 of that same year.

He is accused of assaulting a 69-year-old resident of the St. Mary Infirmary. Lowe has always maintained his innocence in relation to the allegations against him.

The allegations about the rape were widely reported and caused shock among many across the nation.
