A preliminary hearing into a case of grievous body harm against Cislyn Fowler is to continue in the St. Ann’s Bay Resident Magistrates court on November 5, when the complainant is to be cross examined.

The hearing started on Monday, September 29, before RM Vaughn Facey where the complainant, David Berbick gave his evidence. However, the case was adjourned until November when the complainant is to be cross examined by the defence lawyer.

Cislyn Fowler is accused of using a corrosive substance to douse Berbick. The incident reportedly occurred on February 14 last year outside the accused woman’s gate in New Fine district near Bamboo in the parish.

During Berbick’s evidence on Monday, he told the court that he was friends with the accused woman and her mother before the attack. He also told the court that he was unaware of the motive behind the attack.

VALENTINE DAY

According to the complainant, it was shortly after 6 a.m., on February 14, Valentine Day while returning from his farm and while he was passing the accused woman’s gate, he was attacked. He claimed the woman ran out to him and asked about something he had promised her.

In his evidence, he said he told her that he didn’t have it, but that he was going by his house and would try to give her later. He said the woman told him that he was a joker and poured a substance she had on him. The substance caught him on the left side of his face. He told the court that his skin started to burn and he ran to the community standpipe to get water to cool it down but the burning continued.

Berbick said he later went to the police station at Bamboo, and was told to visit the hospital. He said he spent five days  in the St. Ann’s Bay hospital, receiving treatment, because harm was done to the left side of his face.

He said the attack has caused serious injury to his left eye and his right eye is now being affected. Berbick said he was referred to an eye specialist. He told the court that the act was wicked and evil especially since he didn’t attack the accused woman.

The matter is to continue on November 5.
