A man who was stabbed in the neck while in police custody and was granted bail to improve his safety, was back again before the courts.
The man, Byron Gilzeane, was before the St Ann Parish Court on Thursday, August 26, for criminally trespassing on someone’s property.
It is alleged that on the day in question, Gilzeane was seen trespassing in a man’s yard.
No further details of the case were revealed in court.
“Sir, were you trespassing in someone’s yard,” presiding parish judge Vaughn Facey asked Gilzeane.
“Yes sir,” Gilzeane replied.
Judge Facey explained that Gilzeane did not waste the courts time and had shown some remorse for his actions when he gave a guilty plea at the first hearing of the case against him.
Judge Facey told him that the fine would have been $20,000, but he considered the fact that no damage was done to the property.
Gilzeane was fined $10,000 or 30 days in prison.
However, he asked Judge Facey for some time to pay the fine.
The judge later considered bail.
It was at this time it was revealed that Gilzeane was granted bail in early August after he told the court that he received stab wounds to his neck while in police custody.
Gilzeane was charged for unlawful possession of property.
He was stabbed by another inmate, Damion Lewis, who has a robbery with aggravation charge against him.
However, there were no details about how Gilzeane was stabbed and why.
The issue was brought up by the crown prosecutor, who indicated to then parish judge Peter Wilson, the safety concerns the man could continue to face while incarcerated.
Judge Wilson then saw it fit for Gilzeane to be released under the circumstances. That case will be mentioned on September 20 and Gilzeane was granted bail in the sum of $60,000 with one surety.
BAIL AGAIN
Judge Facey decided that Gilzeane could again receive bail as the charges were not similar.
He was granted bail in the sum of $50,000 with one surety.
Gilzeane was told to bring the money to pay the fine on October 12.
